Q.중학교2학년 때 미국에 가서 만21세 이후에 형과 함께 영주권 취득을 하고 부모님께서도 미국에 거주
    하시며 영주권자 이십니다.곧 시민권이 나오는데,제가 한국 국적을 포기하고 미국 시민권을 받더라도,
    한국에서 취업을 하고 금융 부동산 거래를 할 수 있는지 궁금합니다.

    F4 비자 취득 자격이 되어도,예외로 취득 불가가 나올 수 도 있나요?

귀하의 민원 요지는 미국국적 취득으로 인하여 한국국적을 상실하게 되는 경우 재외동포자격(F-4)과 관련된 것으로 판단됩니다. 

후천적으로 외국국적을 취득하여 대한민국 국적을 상실하게 된 사람에게 재외동포(F-4)자격을 부여할 수 있는 경우는 다음과 같으니 참고하시기 바랍니다. 

1. 17세 이전(17세가 되는 해의 12월 31일까지)외국국적 취득자 

2. 18세 이후(제1국민역 편입 후) 외국국적 취득자 중 다음의 어느 하나에 해당하는 경우 

1) 재외동포자격 신청 시 부 또는 모가 외국국적을 취득한 경우 

2) 해외이주 등의 목적으로 출국하여 외국국적 취득 당시 부모가 영주권을 소지한 경우 

3) 해외이주 등의 목적으로 출국하여 외국국적을 취득한 자로 재외동포자격 신청 시 부모 또는 부모의 일방이 외국을 주된 생활 근거지로 하여 1년 기준 6개월 이상 체류한 경우. 단, 병역법 시행령 제145조 4항 각호에 규정된 국외여행허가제한사유에 해당하는 사람은 제외 

위 대상자에 해당되어 재외동포자격을 부여받은 경우 취업과 부동산 거래는 가능함을 알려드립니다.(단순노무업종 취업제한 등 일부제한)

Q. I came to the USA when I was in the second year of middle school.
 I got a green card with my elder brother at the age of 21(full 21 years old).
 My parents are also permanent residents living in the USA. I will get citizenship sooner or later.
 If I give up my Korean citizenship and become an American citizen, is it possible for me to get a job and also do financial and real estate transactions in Korea?
Also I wonder if F4 visa may be exceptionally refused to even those who are qualified to get F4 visas.

Thank you for your question. This is Korea Immigration Service, a Ministry of Justice-affiliated organization. The point of your question seems to relate to F-4 visa acquirement in the case of the loss of a Korean citizenship due to acquisition of American citizenship. 

In the case of those who are losing their Korean nationality due to acquisition of foreign nationality, those who are affected by the items below can get F-4 qualification. 

1. Those who obtained a foreign nationality before the age of 17(by 31 December of the year when they were 17) 

2. If those who got a foreign nationality after the age of 18 (after transferring to eligible conscription status) are affected by the items below, 

  1) Those who have parents(at least one parent) who got a foreign nationality at the time when they apply for F-4 visas, 

  2) Among those who went abroad for immigration or other purposes, where they have parents who had obtained permanent residency at the time when they got foreign nationality,

  3) Among those who got foreign nationalities after going abroad for immigration or other purposes, where their parents or at least one-parent stayed in a foreign country for more than 6 months a year. Those who come under the category of reasons for domestic travel restrictions defined on Clause 4, Article 145 of Enforcement Ordinance of the Military Service Law are excluded.
  

Those who are affected by the above items and thus got F-4 status are able to not only be employed but also do financial and real estate transactions in Korea. (Some of jobs including simple labor, etc, are restricted.)
